Section 12-8-580 of the South Carolina Code requires a person who acquires real property, or real property and related tangible personal property, from a nonresident seller to withhold South Carolina income taxes from the seller.
The amount of withholding is determined by the kind of taxpayer and the information provided by the seller to the buyer.
The buyer is responsible for collecting and remitting the withholding on Form I-290 to the Department.
The seller is required to disclose the sale's gain or loss on a promptly filed South Carolina income tax return; any excess withholding computed on the seller's income tax return is then reimbursed.
